Strengthening of cooperation between the Regulatory Authority and the Competition Council

As part of the strengthening of institutional dialogue and the promotion of healthy and fair competition in the postal and electronic communications markets, a meeting was held today, 4 June 2025, between the Regulatory Authority of Post and Electronic Communications (ARPCE), and the Competition Council in accordance with the provisions of Ordinance No 03-03 of 19 July 2003, as amended and supplemented, on competition, in particular Articles 39 and 50.

The meeting provided an opportunity for an in-depth discussion on the state of competition in the postal and electronic communications markets, the issues involved in regulating them, and the possible synergies between the two institutions in terms of monitoring and intervening in anti-competitive practices.

The main items on the agenda were as follows:

  • A reminder of the legislative and regulatory provisions governing the postal and electronic communications markets, and an overview of the current state of these markets;
  • A reminder of the provisions governing competition, in particular Articles 39 and 50 of Ordinance 03-03 of 19 July 2003, as amended and supplemented, relating to competition;
  • Examination of cooperation mechanisms between the two parties, in particular through the creation of a working group comprising representatives of both parties.

At the end of the meeting, it was agreed to sign a cooperation agreement aimed at establishing a formal and structured framework for exchanging information, coordinating actions and holding regular consultations, with a view to ensuring the harmonious application of competition rules.

Through this initiative, the two parties have reaffirmed their commitment to work together to ensure compliance with competition rules, prevent restrictive practices and promote a fair and transparent economic climate, in the service of sustainable development of the sector and in the interests of postal users and electronic communications subscribers.
