The right to appeal

Subscribers may lodge a complaint with their operator, which is obliged to act on it. If the subscriber is dissatisfied or fails to receive a response from the operator, he or she may refer the matter to the Regulatory Authority.

The right to information

  • The operator must give clear and precise information about the offers it wishes to launch;
  • The operator has an obligation to inform subscribers by publishing its tariffs and general terms and conditions of service offers;
  • It is imperative that the operator inform the subscriber of any changes to the offer available on the market;
  • The operator must not harm the moral interest of the subscriber.

The right to privacy

  • Protection of personal data
  • Operators are required to take appropriate measures to ensure the confidentiality of the personal information they hold and process in compliance with the legal and regulatory provisions in force.

  • Communications confidentiality
  • The operator must ensure the confidentiality of the information it holds on its subscribers as well as the confidentiality of their communications and not to allow the implementation of devices for monitoring telephone communications and electronic exchanges without the prior authorisation of the judicial authority.

  • Protection of children and vulnerable persons
  • The operator is required to provide its subscribers with technological and organisational solutions to protect children or vulnerable persons under their guardianship by restricting access to undesirable destinations or content.

Quality of service

  • Continuity and availability of service
  • In compliance with the principle of continuity and except in cases of duly established force majeure, the operator may not interrupt the supply of services without prior authorisation from the ARPCE. The operator is required to ensure that services are available 24 hours a day, 7 days a week, with the cumulative average period of unavailability, calculated over the entire network, not exceeding 24 hours a year, except in cases of force majeure.

  • The right to universal service
  • The universal communications service constitutes a minimum set of services, including one or more value-added services, which is accessible to the entire population at affordable rates throughout the national territory.

    The universal service aims to increase the number of households with electronic services.
