Personal Data Protection Policy
The purpose of this Personal Data Protection Policy is to define the terms and conditions under which the Regulatory Authority of Post and Electronic Communications (ARPCE) collects, processes, stores, secures and shares your personal data, while ensuring that your rights are respected. This processing is carried out in strict compliance with Law No. 18-07 of 25 Ramadhan 1439, corresponding to 10 June 2018, as amended and supplemented, relating to the protection of individuals with regard to the processing of personal data, as well as with the provisions laid down by the National Authority for the Protection of Personal Data (ANPDP).
Who does this policy apply to?
This policy applies to:
- All individuals or legal entities interacting with the Regulatory Authority of Post and Electronic Communications;
- Electronic communications and postal service operators;
- ARPCE staff.
Definitions
In accordance with the provisions of Law No. 18-07 of 10 June 2018, as amended and supplemented, the following terms are defined as:
- ‘Personal data’: any information, regardless of its medium, concerning an identified or identifiable person, hereinafter referred to as the ‘data subject’, directly or indirectly, in particular by reference to an identification number or to one or more specific elements of their physical, physiological, genetic, biometric, mental, economic, cultural or social identity.
- ‘Data subject’: any natural person whose personal data are subject to processing.
- ‘Processing of personal data’, hereinafter referred to as ‘processing’:any operation or set of operations performed by automated or non-automated means and applied to personal data, such as collection, recording, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or interconnection as well as restriction, encryption, erasure or destruction.
- ‘Data controller’: The natural or legal person, public or private, or the service which, alone or jointly with others, determines the purposes and means of the processing.
Who is responsible for processing your personal data?
The controller of your personal data is the Regulatory Authority of Post and Electronic Communications, an independent institution endowed with legal personality and financial autonomy, created by Law No. 2000-03 of 5 Joumada El Oula 1421, corresponding to 5 August 2000, as amended and supplemented, laying down the general rules relating to postal services and telecommunications, repealed by Law No. 18-04 of 24 Chaâbane 1439, corresponding to 10 May 2018, laying down the general rules relating to post and electronic communications, with its registered office at 1 rue Kaddour Rahim, Hussein dey 16005, Alger.
As data controller, the Regulatory Authority uses your personal data solely for determined and defined explicit purposes. Only the data that are useful to us are collected.
What personal data do we collect?
In the context of performing its duties as laid down by Law No 18-04 of 10 May 2018, the ARPCE collects your personal data, including the following categories:
- Identity data: first name, surname, date and place of birth.
- Contact details: postal address, email address, mobile phone number.
- Professional information : curriculum vitae, qualifications, professional experience.
- Economic and financial data : financial and tax situation, bank or postal accounts details.
- Visit data: information collected during your visits to the ARPCE headquarters.
- Video surveillance : video recordings of visitors at the ARPCE headquarters.
Data Storage Period
Your personal data are stored for as long as necessary to achieve the purposes for which they were collected. They may also be archived for legal reasons.
How are data collected?
Personal data may be collected directly (registration form) or indirectly, manually or automatically, via paper or electronic means, internet, mobile/web applications, instant messaging applications, or during your visits to the Regulatory Authority's headquarters.
Use of data
The personal data collected are used to:
- Improving the quality of services;
- Monitoring of electronic communications and postal operators;
- Managing human resources and recruitment (from recruitment through to final departure);
- Managing your user account;
- Managing your requests for information and legal titles;
- Ensuring the internal security of the Regulatory Authority of Post and Electronic Communications;
- Communicating with individuals interacting with the Regulatory Authority of Post and Electronic Communications;
- Providing the services offered by the Applications: speed tests, test history.
What is ARPCE's commitment?
As data controller, the ARPCE undertakes to implement the appropriate technical and organisational measures to ensure the protection, confidentiality and security of the personal data of any natural person from whom data are collected, in accordance with Law No 18-07 of 10 of 10 June 2018, as amended and supplemented.
How do we ensure the security of your personal data?
The ARPCE undertakes to take all necessary measures, taking into account the nature of the data and the risks associated with the processing, to preserve the security of your personal data and, in particular, to prevent any distortion, damage, or unauthorised access by third parties.
To whom are the data sent?
Your personal data will not be transferred to third parties without your prior consent, except where required by law.
Are your personal data transferred abroad?
Your personal data are not transferred abroad.
What are your rights regarding your personal data?
In accordance with the provisions of the Law No. 18-07 of 10 June 2018, as amended and supplemented, you have the right to information, the right of access, the right to rectification and the right to object.
