Terms and conditions of use of Jawdati

Introduction

The purpose of these General Terms of Use (“CGU”) is to define the rules for using the Jawdati application.

Using the Jawdati application implies your acceptance of these conditions. We invite you to read them carefully.

Concepts

The Regulatory Authority of Post and Electronic Communications (hereinafter the “ARPCE”) is an independent institution with a legal personality and financial autonomy, created by Act No. 2000-03 of 5 Jumada al-Awwal 1421 corresponding to 5 August 2000, amended and supplemented, laying down the general rules on post and telecommunications, repealed by Law No. 18-04 of 24 Sha’ban 1439 corresponding to 10 May 2018 laying down the general rules on post and electronic communications in Algeria.

We understand equipment or device as referring to any phone, tablet or communications device running the Android operating system.

We understand by user any natural person using the Jawdati application on a device.

We understand by application the Jawdati application and all related services.

What is Jawdati?

Jawdati is a mobile application used to measure Internet quality of service in Algeria. It collects data about the results of tests measured by subscribers to electronic communication services and sends the data collected to ARPCE for processing and analysis. The studies and statistics, carried out on this data, will enable ARPCE to make the best decisions to improve the quality of service (“QoS”) of mobile and fixed communication network operators in Algeria.

Data collected

The data collected through the use of the application is subject to the provisions of Law No. 18-07 of 10/06/2018 relating to the protection of individuals in the processing of personal data. This data is processed exclusively by ARPCE.

The data collected by the application is as follows:

  • Device information: The application collects information from the device (brand, model and operating system).
  • Location type: The application asks the user whether it is an internal (Indoor) or external (Outdoor) location.
  • Location data: It is important to activate location (GPS) services before launching the quality of service measurement tests. This data enables ARPCE to locate the various areas tested on a map. A test without location is only used for overall statistics.
  • Mobile signal strength: This is the measure of the strength of the radio signal received by the device, from a mobile antenna, expressed in dBm.
  • Mobile network information: The name of the operator, the country code (MCC), the operator identifier (MNC), the mobile phone identifier written on the SIM card (MSIN), as well as the type of mobile network (EDGE, UMTS, LTE, etc.).
  • Information on connectivity: This is the type of access used by the device to access the Internet it can be mobile such as 2G, 3G or 4G, or fixed via Wi-Fi.
  • Latency (Ping): this data is the response time of the connection after a request has been sent to the test server. It is measured in milliseconds (ms).
  • Download speed: This is the speed at which data is sent from the test server. A test without location is only used for overall statistics.
  • Upload speed: This is the speed at which data is sent to the test server. A test without location is only used for overall statistics.

This data will be sent automatically to an ARPCE server. It will be kept for the time required to process it. Under no circumstances will this data be communicated to third parties.

No personal data is collected.

Terms and conditions of use of the Jawdati application

The Jawdati application is available for free and can be downloaded from the “Google Play Store” in the “Tools” category. It is only available in Algeria. It is supported by mobile devices (phones, tablets, etc.) running the Android operating system (minimum supported version Android 4.0.x).

To use the Jawdati application, users must have:

  • A mobile device running Android;
  • A mobile or ADSL Internet package (connected via Wi-Fi).

The Jawdati application can be used to:

  • Carry out connectivity tests on a mobile or fixed-line network (via Wi-Fi).
  • Save the results of any tests performed.
  • Automatically send test results to ARPCE (in the case, where the connection does not allow transmission of results, these will be transmitted at a later date).
  • Consult the latest results of speed tests carried out and forward them if necessary.

Jawdati uses a dedicated test server provided by ARPCE.

The user undertakes not to hinder the proper functioning of the application and the Jawdati application services in any way whatsoever and not to send over or using the application any element that has the effect of damaging or rendering inoperative the application or any of its services. Users also undertake never to intercept, interfere with or send fraudulent data using the application.

In this respect, ARPCE cannot be held liable for any damage resulting from the loss, alteration or fraudulent use of data, the accidental transmission of viruses, the attitude or behaviour of a third party, or other harmful elements.

ARPCE accepts no liability for inability to access the application, misuse of the application or saturation of the Internet network used, or for the devices used malfunctioning in any way.

ARPCE reserves the right to improve the application by adding new functions or refining existing ones.

ARPCE reserves the right to temporarily suspend or discontinue the application at any time and for any reason whatsoever.

These General Terms and Conditions of Use are governed by Algerian law.

In the event of a change to the General Terms and Conditions, users will be asked to renew their acceptance of these Terms and Conditions in order to continue to access the Service.
